Status of OSH Adoption of Federal Standards

Agriculture

Currently there are no federal agriculture standards being reviewed.

Construction Industry

29 CFR 1926.95 – Employer Payment for Personal Protective Equipment – final rule. The OSH Division reviewed this final rule and adopted it verbatim. The North Carolina effective date is February 13, 2008Employers must implement the PPE payment requirements no later than May 15, 2008.

General Industry

29 CFR Part 1910 - Update OSHA standards based on National Consensus Standards - final rule. The OSH Division reviewed this final rule and adopted it verbatim. The North Carolina effective date was April 17, 2008.

29 CFR 1910.132 – Employer Payment for Personal Protective Equipment – final rule. The OSH Division reviewed this final rule and adopted it verbatim. The North Carolina effective date is February 13, 2008Employers must implement the PPE payment requirements no later than May 15, 2008.

29 CFR 1910 - Subpart S - Electrical Standard- final rule. The OSH Division reviewed this final rule and adopted it verbatim. The North Carolina effective date was August 13, 2007.

29 CFR 1910.1026 – Occupational Exposure to Hexavalent Chromium – final rule. The OSH Division reviewed this settlement agreement for application in North Carolina.  The OSH Division will not abide by the terms of this settlement agreement with the Surface Finishing Industry Council.

Maritime

29 CFR Part 1915 - Updating National Consensus Standards in OSHA’s Standard for Fire Protection in Shipyard Employment – direct final rule.  The OSH Division reviewed this direct final rule and adopted it verbatim. The North Carolina effective date was May 2, 2007.

29 CFR 1915.152 and 1917.96 – Employer Payment for Personal Protective Equipment – final rule. The OSH Division reviewed this final rule and adopted it verbatim. The North Carolina effective date is February 13, 2008Employers must implement the PPE payment requirements no later than May 15, 2008.

OSH Division State Rulemaking Activity

Personal Protective Equipment – 13 NCAC 7F.0104

Effective May 15, 2008, OSHNC repealed the state-specific requirement in general industry for employer payment for personal protective equipment as it was less effective than the new federal rule on the same subject.
